If you use the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Your Account

You are responsible for:

• Maintaining the confidentiality of your login credentials;
• All activity that occurs under your account;
• Notifying us immediately if you suspect unauthorized access;
• Keeping your health and profile information reasonably accurate.

4. Educational Purpose Only

BioMind Health is an AI-powered educational platform designed to help users understand the relationship between lifestyle, nutrition, environment, biology, and health. It merges ancient wisdom with modern AI intelligence for the purpose of learning and personal awareness.

BioMind Health does not provide medical advice, diagnosis, or treatment. Nothing on the Platform should be interpreted as medical advice or as a substitute for consultation with a qualified healthcare professional. 5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful, harmful, or fraudulent purpose;
• Upload viruses, malware, or any code designed to disrupt the Platform;
• Attempt to gain unauthorized access to other accounts, servers, or networks;
• Scrape, crawl, or systematically extract data without written permission;
• Reverse-engineer, decompile, or copy any part of the Platform;
• Impersonate any person or entity, or misrepresent your affiliation;
• Harass, threaten, or harm other users;
• Post or transmit content that is defamatory, obscene, or infringes third-party rights;
• Use the Platform to provide medical advice or diagnosis to others.

We reserve the right to suspend or terminate accounts that violate these rules.

6. Subscriptions & Billing

BioMind Health offers both Free and Premium plans. By subscribing to Premium:

• You authorize us (through our payment processor) to charge your selected payment method;
• Subscriptions renew automatically at the end of each billing cycle unless cancelled;
• Prices are shown in your local currency at checkout and may vary by region;
• You may cancel at any time from your account settings — cancellation takes effect at the end of the current billing period;
• Refunds are handled according to our Refund Policy;
• We may change subscription prices with reasonable advance notice. Continued use after a price change constitutes acceptance.

All payments are processed by secure third-party providers. BioMind Health does not store your full card details on its servers.

7. Intellectual Property

All platform materials — including text, algorithms, source code, visual elements, brand identity, and content — are the intellectual property of BioMind Health Global and are protected by copyright, trademark, and other applicable laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for your personal, non-commercial use, subject to these Terms.

You may not copy, modify, distribute, sell, sublicense, or create derivative works of any part of the Platform without our prior written consent. Reproduction or distribution without written permission is strictly prohibited.

8. Privacy & Data Protection

We adhere to global data protection standards, including GDPR and HIPAA principles, where applicable. Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal and health data.

• Ownership: You retain ownership of the health data you provide;
• License: You grant us a limited license to process your data to provide the Platform;

• No sale: We never sell your personal data to third parties.

You acknowledge that:

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or secure;
• Any information obtained through the Platform will be accurate, complete, or reliable;
• Defects in the Platform will be corrected;
• The Platform will meet your specific requirements.

While BioMind Health strives for accuracy, all data, algorithms, and AI insights are continually evolving and may contain inaccuracies or incomplete information. AI interpretations are probabilistic — insights are generated using learned correlations, not certainties. Any reliance you place on the Platform is strictly at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, BioMind Health, its developers, partners, affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform.

This includes, without limitation, damages for:

• Loss of profits, data, or goodwill;
• Personal injury or adverse health outcomes;
• Service interruptions or errors;
• Unauthorized access to your data.

Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid BioMind Health in the 12 months preceding the claim, or (b) INR 5,000 / USD 60.

12. Termination

You may stop using the Platform and delete your account at any time from your settings.

We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have:

• Violated these Terms;
• Engaged in fraudulent, abusive, or illegal activity;
• Posed a security or legal risk to BioMind Health, our users, or third parties.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will:

• Update the "Last updated" date at the top of this page;
• Notify you by email or in-app notification for material changes;
• Provide reasonable advance notice before the new Terms take effect.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in India.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
